VESSOL TERMS OF SERVICE AND PRIVACY

Welcome to Vessol. These Terms of Service (“Terms”) govern your access to and use of the website located at [vessol.io] (the “Site”), and any products, features, or services offered by Vessol, LLC, a Idaho limited liability company (“Vessol,” “we,” “us,” or “our”), including the purchase of physical products through the Site (collectively, the “Services”).

By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, and able to form a binding contract to use the Services. By using the Services, you represent that you meet these requirements. If you use the Services on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

2. Account Registration

Certain features of the Services, including placing orders and accessing order history, require you to create an account. When you register, you agree to:

  • Provide accurate, current, and complete information;
  • Maintain and promptly update your account information;
  • Keep your login credentials confidential and not share your account with others;
  • Notify us immediately at info@vessol.io of any unauthorized use of your account or other security breach.

You are responsible for all activity that occurs under your account, whether or not authorized by you. We may suspend or terminate your account if any information you provide is inaccurate, false, or incomplete, or if we suspect unauthorized use.

3. Products, Pricing & Orders

We strive to display product descriptions, images, and pricing accurately, but we do not warrant that product descriptions, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in pricing or product information, or unavailability of inventory. If we cancel an order after payment has been charged, we will issue a full refund of the amount charged.

Prices are listed in U.S. dollars unless otherwise stated and do not include applicable taxes, duties, or shipping fees, which will be added at checkout. Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

Certain products or services may be available exclusively online through the Site. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear on the Site. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on the Site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

4. Payment

You agree to provide current, complete, and accurate payment information for all purchases made through the Services. By submitting payment information, you authorize Vessol and its third-party payment processors to charge the applicable amount to your chosen payment method.

We use third-party payment processors to handle transactions and do not store full payment card details on our servers. Your use of any third-party payment processor is subject to that processor's own terms and privacy policy.

5. SMS/Text Messaging Communications

By providing your phone number and opting in through the Site, checkout, or another sign-up form, you consent to receive recurring automated text messages (SMS/MMS), including order and shipping updates, cart reminders, and promotional or marketing offers, from Vessol at the number provided. Consent to receive these messages is not a condition of any purchase.

Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out of receiving text messages from us, or reply HELP for assistance. Carriers are not liable for delayed or undelivered messages.

6. Shipping & Delivery

Estimated shipping and delivery times are provided for convenience and are not guaranteed. Title and risk of loss for products pass to you upon our delivery to the carrier. Vessol is not responsible for delays, loss, or damage caused by the shipping carrier, customs processing, or events outside our reasonable control.

7. Returns, Refunds & Cancellations

30-Day Return Guarantee

We want you to be genuinely happy with your gear. If it's not working out, you have 30 days from the date of purchase to return it for a full refund — no hassle.

To initiate a return, contact us at info@vessol.io. Refunds, once approved, will be issued to the original payment method within a reasonable time. Certain items may be marked as final sale and ineligible for return.

8. User-Generated Content

The Services may allow you to submit reviews, ratings, comments, photos, or other content (“User Content”). By submitting User Content, you grant Vessol a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and create derivative works from your User Content in connection with operating and promoting the Services, in any media now known or later developed.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate any third party's rights or any applicable law. You agree not to submit User Content that is unlawful, defamatory, obscene, infringing, fraudulent, or otherwise objectionable.

We reserve the right, but have no obligation, to monitor, edit, or remove any User Content at our sole discretion and without notice.

9. User Comments, Feedback and Other Submissions

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, “comments”), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit, or remove content that we determine in our sole discretion is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable, or violates any party's intellectual property or these Terms of Service.

You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality, or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive, or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.

10. Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems and networks;
  • Use any automated means, including bots, scrapers, or crawlers, to access the Services without our prior written consent;
  • Resell or exploit any portion of the Services for commercial purposes without authorization;
  • Upload viruses, malware, or other harmful code;
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

11. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Vessol or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.

12. Privacy

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device (“Device Information”). We collect Device Information using the following technologies:

When we talk about “Personal Information” in this section, we are talking both about Device Information and Order Information.

Our Site is built on and operated using the Shopify, Inc. ecommerce platform. Shopify processes Order Information and Device Information on our behalf to provide hosting, checkout, payment processing, and order fulfillment services, and acts as a service provider with respect to that Personal Information. VESSOL DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VESSOL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. VESSOL'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO VESSOL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless Vessol and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your User Content, or your violation of these Terms.

16. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for violation of these Terms. You may stop using the Services and close your account at any time. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

17. Governing Law

These Terms are governed by the laws of the State of Idaho, United States, without regard to its conflict-of-law principles, except where preempted by U.S. federal law. You agree to the exclusive jurisdiction of the state and federal courts located in Idaho for any dispute arising out of or relating to these Terms or the Services.

18. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will provide notice, such as by posting an updated version on the Site or sending you an email. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Vessol regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision will not be deemed a waiver. You may not assign these Terms without our prior written consent; we may assign these Terms without restriction.
